These terms apply when you browse the Austpek Trade Partner Directory, submit a quote request or use the Directory to contact a Trade Partner. The Directory is operated by Austpek Pty Ltd ABN 85 092 996 328, trading as Austpek Bathrooms (Austpek, we, us or our). 

By submitting a quote request, you agree to these terms. Your use of the wider Austpek website and any purchase of products from Austpek are also governed by Austpek’s Website Terms and Privacy Policy. If there is an inconsistency about the Directory, these terms prevail. If you do not agree, do not submit a quote request through the Directory. 

Nothing in these terms excludes, restricts or modifies any right, guarantee or remedy that cannot lawfully be excluded, including under the Australian Consumer Law. 

1. Definitions 

In these terms: 

  • Customer means a person who browses the Directory, submits a Quote Request or contacts a Trade Partner through it. 

  • Directory means Austpek’s online Trade Partner listings and related matching, contact and quote-request features. 

  • Quote Request means information a Customer submits seeking contact from a selected Trade Partner. 

  • Trade Partner means an independent business displayed in or receiving a Quote Request through the Directory. 

  • Trade Services means building, plumbing, electrical, design, installation, renovation or other services offered by a Trade Partner. 

  • Verification Standard means Austpek’s published Austpek Verified Standard, as updated from time to time. 

2. Austpek’s role 

Austpek supplies the Directory and introduction service. Unless Austpek expressly agrees otherwise in a separate written contract, Austpek does not supply the Trade Services. 

Trade Partners are independent businesses. They are not Austpek’s employees, agents, subcontractors, franchisees, joint venturers or representatives. Austpek does not prepare or approve their quotes, set their prices, collect payment for their work, supervise their work or provide their workmanship warranty. 

Austpek is not a party to a contract between a Customer and a Trade Partner. The Trade Partner is responsible for its quotes, contracts, staff, subcontractors, work, statutory obligations, warranties, payments and disputes. 

A listing, introduction or badge is not a guarantee that a Trade Partner is suitable for your project. The Directory may not include every suitable provider, and listing order is not a quality ranking unless Austpek expressly says otherwise. Any sponsored or paid placement will be identified as such. 

3. Meaning of “Verified” 

Where a profile displays “Verified”, the badge means only that, on the verification date displayed, Austpek completed the checks stated in the Verification Standard. The badge does not mean Austpek has continuously monitored the Trade Partner or guarantees its workmanship, safety, solvency, pricing, availability, conduct or suitability for a particular project. 

Licence, registration and insurance status can change after the displayed verification date. A certificate of currency does not establish that an insurance policy will respond to a particular claim. You must independently check the exact legal entity you propose to hire, the current licence class and jurisdiction relevant to your work, the personnel attending your site, and current insurance before entering a contract or paying money. 

4. Quote Requests and contact 

When you submit a Quote Request from a Trade Partner’s profile, you ask Austpek to send your request and necessary contact details to that selected Trade Partner so it can assess and respond to the enquiry. Austpek will not send that request to an additional Trade Partner without telling you or receiving a further request from you. 

A Trade Partner may contact you by telephone, email or SMS about that Quote Request. Permission to respond to the Quote Request is not permission to send unrelated marketing. Separate marketing consent is required. 

Austpek does not guarantee that a Trade Partner will receive or accept a request, respond within a particular time, provide a quote, remain available, or honour an indicative price or timeframe. Any quote is issued by the Trade Partner, not Austpek. 

5. Information you submit 

You must be at least 18 years old, provide complete and accurate information, have authority to request services for the relevant property, and use the Directory only for genuine and lawful enquiries. 

Do not include sensitive personal information, payment-card details, identity documents, alarm codes or other information that is unnecessary for the initial quote request. If you upload photographs or files, ensure you have authority to share them and remove unnecessary images of people, addresses, private documents and metadata where practicable. 

Austpek handles personal information under its Privacy Policy and the collection notice displayed at the quote form. Once information is disclosed to the selected Trade Partner, that independent business is responsible for its own handling of the information under applicable privacy law and its privacy policy. 

6. Your checks before hiring 

Before engaging a Trade Partner, you should independently check: 

  • the correct contracting entity, ABN, registered business name and contact details; 

  • current licences, registrations, licence classes, conditions and operating jurisdictions; 

  • current public liability, workers compensation and other insurance relevant to the work; 

  • experience, recent references and suitability for your particular project; 

  • whether permits, approvals, certificates, statutory contracts or home building compensation insurance are required; 

  • a written quote or contract covering scope, exclusions, GST, deposits, progress payments, variations, timing, warranties, rectification and disputes; and 

  • product dimensions, specifications and manufacturer installation requirements. 

Do not rely solely on a profile, badge, photograph, review or statement in the Directory. Government licensing and building requirements vary between jurisdictions and by the value and type of work. 

7. Your contract, payments and Trade Services 

Any engagement is made directly between you and the Trade Partner. You and the Trade Partner must agree the scope, price, deposit, payment schedule, variations, access, timing, completion, insurance, warranties and remedies. 

Payments for Trade Services are made directly to the Trade Partner unless Austpek clearly states otherwise in a separate service. Austpek does not hold Trade Partner deposits and does not guarantee payment security, refunds, completion or workmanship. 

A purchase of products from Austpek and a contract for Trade Services are separate contracts. A Trade Partner cannot vary Austpek’s product terms or make promises on Austpek’s behalf. Austpek is not responsible for damage or defects caused by a Trade Partner’s installation, but nothing in these terms limits rights you may have against Austpek for goods supplied by Austpek or against the Trade Partner for its services. 

8. Profiles, projects and reviews 

Profiles and project images may contain information supplied by Trade Partners or obtained from third-party registers. Austpek may perform the checks stated in the Verification Standard, but does not guarantee that third-party information remains complete or current after the check date. 

If reviews are displayed, they must reflect genuine first-hand experience. Reviews may be moderated under Austpek’s published review policy. Austpek may request supporting information and remove content that appears fake, unlawful, irrelevant, abusive, defamatory or privacy-infringing. Austpek will not suppress a genuine negative review merely because it is unfavourable. 

9. Acceptable use 

You must not: 

  • submit a false request, impersonate another person or harvest contact details; 

  • scrape, copy, republish, reverse engineer or commercially exploit the Directory without permission; 

  • introduce malicious code, interfere with the Directory or attempt unauthorised access; 

  • use information from the Directory to send spam or unrelated marketing; or 

  • use the Directory unlawfully or in a way that infringes another person’s rights. 

10. Availability and external links 

Austpek will take reasonable care in operating the Directory but does not guarantee uninterrupted, secure or error-free availability. Austpek may change or discontinue features where reasonably necessary, subject to non-excludable legal obligations. 

External websites are controlled by their operators. A link does not make Austpek responsible for the external site, its privacy practices or its content. 

11. Complaints and safety issues 

A complaint about Trade Services should first be directed to the Trade Partner. Austpek may receive a complaint, request information, pass communications between the parties, retain relevant records and consider whether a listing or badge should remain active. Austpek is not obliged to adjudicate a customer–Trade Partner dispute or compel a refund, rectification or payment. 

Report suspected fraud, misuse of personal information, expired credentials or a serious safety issue to sales@austpekbathrooms.com.au. Nothing prevents you from contacting an insurer, emergency service, licensing authority, consumer protection body, tribunal or court. 

12. Liability and Australian Consumer Law 

Nothing in these terms excludes liability that cannot lawfully be excluded. Austpek remains responsible to the extent a loss is directly caused by Austpek’s own breach of law, breach of contract, negligence or misleading conduct. 

To the extent permitted by law, Austpek is not responsible for the acts or omissions of a Trade Partner or for the quality, safety, legality, price, timing or outcome of Trade Services, because those services are independently supplied under the contract between you and the Trade Partner. 

You must take reasonable steps to avoid or reduce loss, including checking credentials, confirming the identity of the payee, obtaining written terms and promptly reporting suspected misuse. 

13. Changes and general terms 

Austpek may update these terms for legal, security, operational or service changes. The current version will state its effective date. Changes apply prospectively and do not alter a contract already formed directly between you and a Trade Partner. 

If part of these terms is invalid or unenforceable, it will be read down or severed without affecting the remainder. A delay in enforcing a right is not a waiver. 

These terms are governed by the laws of New South Wales, Australia. The parties submit to the non-exclusive jurisdiction of its courts, subject to any mandatory rights or forum available under applicable consumer law.
